01Acceptance of Terms
These Terms of Service ("Terms") govern your access to and use of the Bloomingle mobile application and related services (the "Service"), operated by Frixas Technology Services LLC ("Bloomingle," "we," "us"). By creating an account or otherwise using the Service, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, do not use the Service.
02Eligibility
You must be at least 18 years old to create an account or use the Service. By using Bloomingle, you represent and warrant that:
- You are at least 18 years old
- You have not been convicted of, or required to register as, a sex offender under any jurisdiction's law
- You are not prohibited from using the Service under applicable law
- All information you provide during registration is accurate and truthful
- You will comply with these Terms and all applicable laws
03Your Account
You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. Notify us immediately of any unauthorized use of your account.
You may only create and maintain one active profile. Impersonating another person, or creating a profile on behalf of someone else without their consent, is prohibited.
04User Conduct
You agree not to:
- Provide false information, including about your age, identity, or photos
- Harass, threaten, stalk, or abuse another user
- Use the Service for any commercial solicitation, advertising, or unauthorized promotion
- Post content that is unlawful, obscene, hateful, or infringes another person's rights
- Attempt to access another user's account or Bloomingle's systems without authorization
- Use bots, scrapers, or automated means to access or interact with the Service
- Solicit money, gifts, or financial information from other users
- Share another user's personal information without their consent
We rely on user reports to help identify violations of these Terms. If a user violates these Terms, we may remove content, suspend, or terminate their account at our discretion.
05Safety & In-Person Meetings
Bloomingle provides safety tools — including profile verification and date check-ins — but cannot guarantee the identity, intentions, or conduct of any user. You are solely responsible for your own safety when interacting with other users, online or in person.
We strongly recommend that you:
- Meet in a public place for initial in-person meetings
- Tell a friend or family member where you're going and who you're meeting
- Avoid sharing financial information, passwords, or sensitive personal details with matches
- Trust your instincts — if something feels wrong, leave and report the user to us
- Never send money or gifts to someone you have not met in person
Bloomingle does not conduct criminal background checks on users. Photo verification confirms that a profile's photos reasonably match a live selfie — it does not verify a user's identity, intentions, or criminal history.
06User Content
You retain ownership of the photos, messages, voice notes, and other content you submit to the Service ("User Content"). By submitting User Content, you grant Bloomingle a non-exclusive, worldwide, royalty-free license to host, store, display, and process that content as necessary to operate and improve the Service, including for compatibility scoring and AI-assisted features described in our Privacy Policy.
You represent that you have the right to submit your User Content and that it does not infringe any third party's rights.
07Subscriptions & Payments
Bloomingle may offer optional paid features or subscriptions. Prices, features, and billing terms will be presented at the time of purchase. Subscriptions may automatically renew unless canceled before the renewal date, in accordance with the app store (Apple App Store or Google Play) through which you subscribed. Refunds are subject to the applicable app store's refund policy.
08Intellectual Property
The Service, including its design, features, text, graphics, logos, and software, is owned by Frixas Technology Services LLC and protected by intellectual property laws. You may not copy, modify, distribute, or create derivative works based on the Service without our written permission.
09Termination
You may delete your account at any time through the app. We may suspend or terminate your account, with or without notice, if we believe you have violated these Terms, engaged in unsafe or fraudulent behavior, or for any other reason at our discretion. Upon termination, your right to use the Service ceases immediately.
10Disclaimers
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. BLOOMINGLE DOES NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR THAT MATCHES OR THEIR CONDUCT WILL MEET YOUR EXPECTATIONS.
11Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY LAW, BLOOMINGLE AND ITS OWNERS, EMPLOYEES, AND AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE SERVICE, INCLUDING ANY INTERACTIONS OR MEETINGS WITH OTHER USERS, WHETHER ONLINE OR IN PERSON. OUR TOTAL LIABILITY FOR ANY CLAIM ARISING FROM THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID US, IF ANY, IN THE 12 MONTHS PRECEDING THE CLAIM.
12Indemnification
You agree to indemnify and hold harmless Bloomingle and its owners, employees, and affiliates from any claims, damages, or expenses (including reasonable attorneys' fees) arising from your use of the Service, your violation of these Terms, or your interactions with other users.
13Dispute Resolution
